Federal Judges Block Trump Deportation Efforts Under Alien Enemies Act
Federal judges across multiple states have sharply criticized the Trump administration’s use of the Alien Enemies Act to deport alleged gang members without due process. U.S. District Judge Paula Xinis rebuked the administration for what she described as willful noncompliance and obstruction in the case of Kilmar Abrego Garcia, demanding more detailed responses and compliance with court orders. Meanwhile, U.S. District Judge Alvin Hellerstein in New York extended a block on deportations of alleged Tren de Aragua gang members, comparing the administration’s tactics to a 'medieval inquisition' and emphasizing that due process must be afforded before removal. The Supreme Court has also paused some deportations under the act, pending further review, but has not yet ruled on the government’s authority to use the law for this purpose. These judicial actions reflect a broader pushback against efforts to expedite deportations based on alleged gang affiliations, particularly when identification relies on factors like tattoos and without individual hearings. The administration defends its approach as necessary for public safety, while judges insist that constitutional protections and procedural rights must be upheld.
