Oath Keeper Caldwell's Obstruction Charge Vacated
Thomas Caldwell, involved in the Jan. 6, 2021 Capitol attack with the Oath Keepers, was sentenced to time served after being convicted of tampering with evidence, as the Supreme Court vacated his obstruction charge. Despite prosecutors seeking a four-year sentence, U.S. District Judge Mehta found the evidence against Caldwell not overwhelming and decided against further imprisonment. Meanwhile, Kellye SoRelle, a former lawyer for the Oath Keepers, faces a recommended 16-month sentence for obstruction of justice after instructing militia members to destroy evidence related to the Capitol riot. SoRelle, who did not enter the Capitol, but collaborated closely with Oath Keepers founder Stewart Rhodes, has pleaded guilty to charges stemming from the riot. SoRelle's sentencing is set for January 17, with prosecutors also recommending supervised release. Rhodes, convicted of seditious conspiracy, is serving an 18-year prison sentence.
