Federal Judge Upholds Florida Prison Policy on Transgender Care
A federal district court judge, Allen Winsor, has upheld a Florida Department of Corrections policy that restricts gender-affirming care for incarcerated transgender individuals, including a ban on cross-sex hormones and social transitions. The ruling came in response to a lawsuit by inmate Reiyn Keohane, who argued that the policy violates the Eighth Amendment's prohibition against cruel and unusual punishment. Winsor determined that the policy does not constitute a blanket ban and that exceptions can be made on a case-by-case basis if deemed medically necessary. The judge noted that Keohane currently receives extensive medical treatment for gender dysphoria, including psychotherapy. Additionally, the court found insufficient evidence to prove that the restrictions on grooming and clothing violate constitutional rights. The ACLU criticized the ruling, stating that it perpetuates a campaign to dehumanize transgender inmates and imposes degrading treatment under the new regulations.
