Judge Denies Live Nation, Ticketmaster's Bid to Dismiss DOJ Antitrust Case
The antitrust lawsuit against Live Nation and Ticketmaster, initiated by the U.S. Department of Justice (DOJ) and 30 state attorneys general, will proceed after a federal judge denied the company's motion to dismiss. U.S. District Judge Arun Subramanian ruled that the DOJ's claims of 'tying'—where artists are allegedly coerced into using Live Nation's promotion services to gain access to its venues—have sufficient merit to move forward. The lawsuit alleges that Live Nation's monopoly power in the concert industry harms consumers and artists by limiting competition among promoters. Judge Subramanian emphasized that the nature of financial arrangements between artists and promoters is a factual issue that needs further exploration. If proven, these claims could lead to significant changes in how Live Nation operates within the live event space. A trial date has yet to be established as the case continues.
