The Department of Health and Human Services (HHS), via the Administration for Children and Families (ACF), found that PREP materials contained content such as lessons distinguishing gender identity from biological sex and recognizing non-binary identities, which it deemed outside the scope of the program's mission. Federal officials argue these references violate the law governing education grants. California officials counter that PREP is evidence-based, comprehensive, and designed for vulnerable youth, insisting all materials are medically accurate and age-appropriate. The state is currently reviewing the directive and has not stated whether it will comply.
