Biden Administration Appeals Title IX Block to Supreme Court

The Biden administration has petitioned the Supreme Court to lift lower court injunctions that block the enforcement of new Title IX rules in GOP-led states. These rules, updated in April, include protections against discrimination based on gender identity and sexual orientation, as well as provisions for pregnant and lactating students. The Solicitor General argues that the injunctions should only apply to the contested gender identity provisions, not the entire rule. Lower courts in Louisiana and Kentucky issued the injunctions, affecting 15 states, following lawsuits claiming the administration misinterpreted a 2020 Supreme Court decision. The administration cites Justice Neil Gorsuch's opinions supporting broader definitions of sex discrimination. The Supreme Court has invited responses from the GOP-led states involved in the challenges.
