FIRE argues that the lawsuit is a Strategic Lawsuit Against Public Participation (SLAPP) aimed at punishing Selzer for her political predictions, violating First Amendment rights. Trump's legal team claims that the poll misled voters, asserting that millions were deceived by the results. Selzer, however, denies any wrongdoing and maintains that her polling methods were transparent and well-documented.
