The court ruled that TikTok's algorithmic recommendations constitute the company's own speech, making it potentially liable under Section 230 of the Communications Decency Act, which usually protects platforms from content posted by third parties. This decision comes after a district court had dismissed the case, citing Section 230. The appeals court's ruling aligns with a recent Supreme Court decision that algorithms reflect companies' editorial judgments, thus not protected by Section 230 immunity. The case has been sent back to the lower court for further proceedings.
