Arizona Court Allows Challenge to Prop 211
The Arizona Supreme Court ruled that Republican legislative leaders have standing to challenge Proposition 211, the 2022 voter-approved Voters' Right to Know Act, and sent the case back to a trial court to decide whether portions delegating rulemaking authority to the Citizens Clean Elections Commission violate the state Constitution. Justice Clint Bolick wrote the majority opinion, joined by four other justices, saying voters did not automatically grant the commission blanket power to implement the law. The justices also raised concerns about potential burdens on free speech and privacy and noted separate private lawsuits making similar claims. Prop 211 — approved by roughly 72% of voters — remains in effect and requires disclosure when groups spend thresholds such as $50,000 statewide, $25,000 for local races, and reporting donors who give at least $5,000. House Speaker Steve Montenegro called the ruling a victory for separation of powers, while proponents including former Attorney General Terry Goddard and national disclosure advocates said they will continue defending the law.
