ACLU Challenges Bucks County Sheriff Authority to Join Federal Immigration Program

The American Civil Liberties Union (ACLU) of Pennsylvania has urged Bucks County Sheriff Fred Harran to withdraw his application to join the federal ICE 287(g) immigration enforcement program, citing a lack of legal authority without approval from the Bucks County Commissioners as required by the Pennsylvania Constitution and state law. The ACLU warned that proceeding without such approval could lead to legal action and potential litigation costs for taxpayers. Sheriff Harran, a Republican seeking reelection, asserts the program would only authorize deputies to handle individuals with warrants and provide access to federal databases, denying intentions to conduct immigration raids. However, county commissioners have stated they have not been informed or approved the agreement, and the sheriff's office has not shared details with them. The ACLU's legal director expects ICE to approve the application unless it is withdrawn and emphasized that the sheriff, while independently operating, does not have the legal authority to bind the county without commissioners' consent. Critics also warn that participation in the program could harm local law enforcement relations and jeopardize residents' rights.
