The Bombay High Court has directed the Mumbai Police to respond to petitions by Mihir Shah and his driver Rajrishi Bidawat, who claim their detention in the BMW hit-and-run case is illegal. Shah, the son of a Shiv Sena leader, was arrested on July 9, two days after allegedly causing the death of Kaveri Nakhwa and injuring her husband Pradeep in an accident. Both Shah and Bidawat are currently in judicial custody. Shah's habeas corpus petition argues that his arrest violated due process under Section 50 of the CrPC, which mandates that the police must inform the accused of the grounds for arrest. The court has scheduled the next hearing for August 29. Shah's father, also involved in the case, has been granted bail.
