Ex-FDNY Firefighter Jailed for Fatal Queens DWI Crash
Former FDNY firefighter Michael Peña has been indicted and jailed after a fatal DWI crash in Queens that killed 23-year-old Justin Diaz, who was on his way to work at LaGuardia Airport. Prosecutors allege Peña was intoxicated, under the influence of drugs, and had a blood alcohol content of .156% with cocaine and marijuana present in his system when he ran a red light at 83 mph—over three times the speed limit—striking Diaz’s car. Peña reportedly had 25 prior speeding violations and a history of arrests, and was previously out on bail before being remanded pending trial. The case has drawn strong responses from Diaz's family, who are calling for justice and emphasizing the risks of reckless driving. Peña, fired from the FDNY after the crash, faces a 14-count indictment and could face up to 15 years in prison if convicted. His next court appearance is scheduled for May 15.
