Michael Jordan’s 23XI Racing Battles NASCAR Over Charter Monopoly in Ongoing Lawsuit
Michael Jordan and Denny Hamlin's NASCAR team, 23XI Racing, along with Front Row Motorsports, are engaged in an ongoing antitrust lawsuit against NASCAR, accusing the organization of monopolistic practices that unfairly control charters, racetracks, and suppliers. The teams secured a preliminary injunction allowing them to compete with guaranteed charter status for the 2025 season, but this was later overturned, forcing them to race as open entries without guaranteed spots or revenue. NASCAR responded by opposing the injunction and sought to sell or reassign the teams' charters, accusing Jordan of attempting to use litigation to gain a permanent charter exclusive to his team. Additionally, NASCAR filed a motion accusing 23XI and FRM of submitting manufactured evidence to the court, a request which was denied by a judge who deemed the motion more about shaping public opinion than advancing the case. The lawsuit, which alleges NASCAR and the France family's monopolistic control over the sport, is set for trial in December 2025, with both sides facing significant legal and commercial stakes. Despite NASCAR's aggressive legal tactics, 23XI and FRM maintain their claim of unlawful monopoly and continue to contest NASCAR's control over the sport.
