Nebraska Court Appeal Filed Over Medical Cannabis Initiatives
The Nebraska Attorney General's Office and Hall County Attorney's Office are appealing the dismissal of charges against notary Jacy C. Todd, accused of notarizing medical cannabis petitions improperly. Todd faces 24 counts of 'official misconduct' related to notarizing petitions without the presence of a paid circulator, who later pleaded guilty to circulator fraud. Separately, former state senator John Kuehn has filed an appeal against a district court ruling that upheld the validity of medical cannabis ballot measures, which received significant public support in the recent election. Kuehn claims insufficient valid signatures were gathered for the measures to qualify for the ballot, although the court found no substantial evidence to support his claims. The Nebraska Supreme Court may review the case directly, potentially bypassing the Court of Appeals, as it has done in similar instances. Meanwhile, the successful initiatives are set to take effect on December 12, following certification by the Nebraska Board of Canvassers.
