A North Carolina district attorney has decided not to file charges following the death of 12-year-old Clark Harman at Trails Carolina wilderness camp, citing a lack of criminal intent or recklessness. Harman, who died from asphyxiation after being forced to sleep in a secured bivy sack, was reported to have been agitated prior to his death, but staff did not recognize any medical distress. The investigation revealed that while staff were aware of his agitation, they believed he was not in immediate danger until they attempted to wake him the next morning. Although the autopsy ruled his death a homicide by asphyxiation, the legal standards for involuntary manslaughter were not met, as confirmed by District Attorney Andrew Murray. Trails Carolina has since been shut down and is facing multiple lawsuits, with its property currently for sale. This case highlights ongoing concerns regarding the practices within the troubled teen industry, which has faced accusations of abuse and negligence.
