EU Data Act Enters Force Expanding User Control Over Connected Device Data
The European Union's Data Act officially entered into force, marking a significant advancement in user control over data generated by connected devices such as smartwatches, cars, and industrial machinery. The legislation grants consumers and businesses the right to access, use, and share raw data from their devices, fostering transparency and enabling new business models like affordable repair services and enhanced product maintenance. It also addresses unfair contract terms in business-to-business data-sharing agreements and facilitates users' ability to switch between cloud service providers without technical or contractual barriers. EU Executive Vice-President Henna Virkkunen emphasized that the Data Act aims to empower users, open markets, and reduce administrative burdens while fostering innovation and competition, particularly benefiting small and medium-sized enterprises. The Act complements the earlier Data Governance Act by moving beyond voluntary data-sharing mechanisms to provide clear, enforceable rules, supporting Europe's digital economy and technological sovereignty. Additionally, the European Commission is seeking feedback on a broader digital omnibus package to further simplify EU rules on data, cybersecurity, and AI, aiming to streamline legislation and maintain high standards for online fairness and safety.
