Spain Gains Control Over Gibraltar Visas Residence Permits Under EU-UK Brexit Deal

The EU and UK have agreed on a post-Brexit deal granting Spain significant powers over the issuance of residence permits, visas, and asylum in Gibraltar, aimed at preserving the Schengen Area's visa-free movement once border protections between Gibraltar and Spain are removed. While Spain will conduct residency checks and have a joint role with Gibraltar in immigration and asylum matters, the Gibraltar government retains the final authority on asylum approvals and residence permits, emphasizing that British sovereignty remains intact. The agreement also ensures that the border between Gibraltar and Spain stays open, avoiding delays for the approximately 15,000 Spanish workers who cross daily, and relocating border controls to Gibraltar's airport as it effectively becomes a Schengen entry point. UK visitors to Gibraltar will face two passport checks—one by Gibraltar authorities and another by Spanish officials—who will enforce Schengen rules, including entry validity, potentially sending travelers back to the UK if requirements are not met. Despite Spain's increased border role, Gibraltar will not join the Schengen zone, and officials stress that British sovereignty over the territory is protected.
