Quw’utsun Nation Wins Landmark Land, Fishery Rights in Richmond
The Cowichan Tribes, part of the Quw’utsun Nation, have won a landmark B.C. Supreme Court case recognizing their Aboriginal title to nearly 7.5 square kilometers of land on Lulu Island in Richmond, including fishing rights on the Fraser River's south arm. The court ruled that previous land grants issued by Canadian and B.C. governments, along with other entities, were invalid as they unjustifiably infringed on the Cowichan Nation’s Aboriginal title. Both federal and provincial governments, as well as other Indigenous groups like the Musqueam and Tsawwassen First Nations, opposed the claim, with the Musqueam expressing deep disappointment and disagreement with the ruling. The court mandated the government to negotiate in good faith with the Quw’utsun Nation to reconcile their land title with existing third-party interests, including those related to the Vancouver Airport Fuel Delivery Project. B.C. Premier David Eby stated the province is reviewing the decision for a possible appeal but emphasized the importance of clear property titles for economic stability, while also committing to negotiations with all involved nations. The Quw’utsun Nation celebrates the decision as a historic victory honoring their ancestors and a step toward truth and reconciliation.
