New Hampshire Teachers, Schools Sue Over Statewide Anti-DEI Law
Four New Hampshire school districts, along with the state's largest teachers' union, advocacy groups, and DEI professionals, have filed a federal lawsuit challenging a new state law that bans diversity, equity, and inclusion (DEI) programs across K-12 schools, public universities, and other state-funded entities. The law, signed by Governor Kelly Ayotte, prohibits DEI initiatives related to race, gender, sexual orientation, gender identity, and disability, and threatens to withhold state funding from entities that do not comply. Plaintiffs argue the law is unconstitutionally vague, infringes on First Amendment free speech rights, and conflicts with federal civil rights protections, particularly for students with disabilities. The lawsuit, supported by the ACLU and several legal organizations, asserts that the law's broad and ambiguous definition of DEI could undermine legitimate educational and support programs, including special education and training aimed at equitable treatment. Since the law's enactment, institutions like the University of New Hampshire have already removed DEI materials and restructured related administrative roles. Critics contend the law imposes severe restrictions that could dismantle efforts to foster inclusive environments, while supporters claim the measures are necessary to comply with federal funding requirements under the Trump administration.
