Nevada AG Convicts 11 in $5.5M Medicaid Fraud Scheme

Nevada Attorney General Aaron Ford announced the conclusion of an extensive Medicaid fraud investigation that began in 2017, resulting in the conviction of 11 individuals involved in a scheme that fraudulently billed Medicaid for mental health services never provided. The investigation uncovered that the fraud ring, linked to two behavioral health companies—Top Notch Behavioral Health and Shepherds Heart Services—billed Medicaid for full shifts, including claims of 24-hour workdays, without delivering any services. Many involved were connected through a church run by Greg and Carol Kirby, with several defendants convicted on charges including conspiracy to commit healthcare fraud and ordered to repay approximately $5.5 million in restitution. Sentences varied from probation to imprisonment, reflecting the differing levels of involvement, with notable convictions including Marcus Millner, who received probation and over $1 million in restitution, and Robert Bailey, who was sentenced to 15 months in prison. The Medicaid Fraud Control Unit, in partnership with other agencies including the IRS Criminal Task Force, spearheaded the investigation and prosecution, underscoring Nevada's commitment to protecting taxpayer-funded resources and ensuring accountability within the Medicaid system.
