Center for Biological Diversity Sues Federal Government Over Delayed Protection of Rare Nevada, California Wetflower
The Center for Biological Diversity (CBD) has filed a lawsuit against the U.S. Fish and Wildlife Service (USFWS) for failing to meet the legally mandated deadline to decide whether to list the rare Tecopa bird’s beak wildflower as endangered or threatened under the Endangered Species Act. The lawsuit alleges that the USFWS missed the September 26, 2024 deadline for a 12-month finding, delaying protections vital to the survival of this groundwater-dependent species found only in three alkali wetland sites across Nevada and California. Threats to the Tecopa bird’s beak include groundwater pumping for agriculture, geothermal energy development, mining, solar projects, and residential expansion, all of which contribute to its risk of extinction. The plant’s reliance on shallow groundwater in some of the nation’s driest areas makes it particularly vulnerable, and experts, including botanist Peri Lee Pipkin, emphasize its ecological importance and the urgent need for federal protection. CBD’s Great Basin director, Patrick Donnelly, criticized the USFWS for the delay and highlighted the critical need to safeguard this species before it is too late. The lawsuit seeks to compel the agency to fulfill its obligations under the Endangered Species Act to prevent the loss of this unique wildflower.
